The way read this law is that it implaments a metroparks style application process across the entire county. Forcing them to get permission for a cache placement. And notifying the county, which may prevent police intervention in the future. As bad as the law looks, that is the basic breakdown that I get for it. And establising a punishment system is not out of line due to placing a cache on private property without permission Is technically tresspassing in all out form.

Just my 2¢

hmm, the part that got me was it cant be in any one place longer than 1 year!

Actually I see this to become the norm in a lot of aeras/ As long as they keep passing the ordinance then we can keep playing. It is when they start banning it all together is when we need to worry.

Brillion only has a half dozen caches.
I wonder if it was overwhelmed with them at some point.

I was most struck by this statement, which reiterates the need to get permission from the Dunkin' Donuts manager, not just the parks...


(c) Geocache Placement throughout the City
(1) Geocaching is prohibited on all other properties throughout the City, unless
special consent has been given by the property owner or authorized
property manager.
(2) Failure to obtain the consent of the property owner or authorized property
manager shall result in potential trespassing and/or disorderly conduct
charges.

What was unclear to me, was that certain requirements seem to apply only to caches hidden on public property, and not to those hidden on private property. Or did I read it wrong?

I'm not a lawyer, but I did stay at a Holiday Inn Express last night.

It outlines city parks as OK with permit.

Then it mentions all other city property as verbotten.

Then it mentions all other property in the city as requiring owners permission. Sure sounds like private property is the only thing left that they can be referring to.

I know the area well, as my father (trainut) is from there. Brillion is not a large town. Brillion has about six caches, three in parks, three in cemetaries. I can understand about private property. I go up there at least once a year to visit family. BTW, I did get a STF (second to find) cache in a park in Brillion, LOL. It was GC1W4XA.

You have to wonder why the city decided to even get involved with this issue. Did something happen 3 1/2 -4 years ago that caused the city fathers to think some regulation was necessary? :shakehead:

At least they did not take a hard-<ahem> stance and ban all geocaching, and the law doesn't look all that restrictive. It almost looks like someone from the Wisconsin Geocaching Association had a hand in the wording of it. It does not read like a lawyer created it.

Anybody have any wisdom about why this particular city chose to pass this law? Somebody tape a geocache to the leg of the city water tower or something? :bat:

after reading the BUMP thread, this thread fits right in...

local geocachers should take note...i think continued vigilance on the issues will inspire us to more preventive actions avoiding another Brillion scenario...

all you need to tell them when they inquire as to what you
are doing in their neighborhood searching:

is what flavor lip gloss you're wearing... :wink:

kinda like name, rank, serial number...
